PRI, Inc. contains copyrighted material that has been assembled,
edited and presented in a variety of formats at great effort and
expense to meet the demand for useful information to commercial
enterprises that are engaged in functions involving the transportation
of hazardous materials.
Because there are exceptions to the copyright law, there is much
confusion about the legality and propriety of various forms of copying,
storage and distribution of copyrighted materials, these following
guidelines are being offered. These guidelines do not constitute legal
advice, a waiver of any of PRI, Inc. civil rights of enforcement, or
are they intended to be a safe harbor to any criminal or civil penalty
imposed by any enforcement authorty. They should however assist you in
complying with restrictions on the use of PRI, Inc.'s publications and
content, both print and web-based. PRI, Inc. reserves the right to
revise these guidelines at any time for any or no reason.
Q. What is a copyright?
The copyright laws give PRI, Inc., exclusive right to reproduce,
prepare derivative works from its content, distribute and publicly
display the materials we publish. It should be noted that these
materials are protected even if they are not registered with the U.S.
Copyright office, or do not carry the copyright symbol "©".
Contrary to popular belief and practice, most copying of
copyrighted materials is not allowed (includes electronic transmission
such as scanning, e-mailing or faxing an article), unless permission or
license has been obtained or the copying is "fair use" as defined by
the copyright laws. "Fair use" is strictly limited to specific
purposes such as criticism, comment, background research, or teaching.
It does not include copying articles and putting them into your file
for later use and reference, nor does it include copying and passing it
along in one form or another to a colleague or business associate. In
addition, it does not include reproduction or content derivation for
the purpose of conducting training classes as these are commercial
enterprises, and otherwise requires permission or the purchase of a
license.
Q. What are the consequences for copyright infringement?
No portion of the PRI, Inc. product may be reproduced in any way
unless permitted under these Guidelines or with express permission from
PRI, Inc. Statutory "fair use" is an exception as is direct
reproduction of United States government works.
Violation of these principals may have serious consequences such as
civil and criminal liabilities for you and/or your employer. Persons
who violate the United States criminal statues against copyright
infringement are prosecuted by US attorneys who have considerable
investigative resources and power at their disposal. Federal
sentencing guidelines are notoriously stiff, as are the fines.
Furthermore, defense costs and the risk of a criminal record are
serious consequences of what might otherwise be seem to be rather
innocent appearing activity.
Q: Why do you bother with having guidelines?
We are in a service industry and engaged in activities which
provide our customers a valuable product, at a reasonable profit. PRI,
Inc. recognizes that a certain degree of reuse may be necessary on an
occasional basis, and therefore customers need some understanding of
what they can or cannot do with PRI, Inc. materials. Because guideline
information can never be completely comprehensive or complete, please
contact the publisher if you have any questions or concerns through the

Keep in mind that we are equipped to provide wide dissemination of
our materials at a reasonable cost in a number of formats and forms,
both print and electronic, at reasonable cost.
Q: What is "occasional" use of the copyrighted material?
We define occasional copying or distribution as an annual per
person maximum of five (5) full articles from PRI, Inc.'s print
publication,The Journal of HazMat Transportation™ and its web related
products, Inc. over a 12 month period. For electronic distribution and
copying, the same limit applies to authorized end users. In all cases,
distribution should be limited to a selected group of recipients.
For example, a corporate compliance officer may e-mail an article
from The Journal of HazMat Transportation™ to a select group of
regional managers, but not to the entire organization, including its
plant locations, regional offices, or all the officers of the firm.
The compliance officer may do this with a maximum of five
articles during a 12-month period.
Proper attribution must be made to The Journal of HazMat
Transportation™ which could be satisfied by sending the article with
all of the page markings, editorial comments and copyright notices in
addition to the following information:

Q: May I copy, e-mail, or fax an entire issue of a publication?
No. You may never make copies of or transmit the entire contents of
a PRI, Inc. Publication even if you have a full subscription. Your
subscription controls how many entire issues may be disseminated in
your entity, group or organization. It does not matter in what form
the transmission is made or if it is done on a one-time basis.
Q: We keep publications like yours in a library where employees
regularly come to the library and make copies of pertinent articles.
We also allow certain employee to review the publication and distribute
selected copies of articles to share with the staff. Is this permitted?
No. You may not permit or allow a regular system to copy and distribute
either articles or the entire issue within your organization.
Employees may copy and article on an occasional basis. If you want to
copy and distribute sections on a systematic, routine or regular basis,
you will need to purchase additional print copies or licenses (or
obtain specific written permission from PRI, Inc., even if you have a
full subscription). Call if one of our regular plans does not fit your
needs.
Q: May I copy the index to The Journal of HazMat Transportation™ and distribute to others in my firm?
No, unless it is on an occasional basis. If you want to copy and
distribute sections on a systematic, routine or regular basis, your
will need to purchase additional print copies or licenses as stated
above.
Note that the index and cover are original and proprietary works and are covered by our copyright.
Q: Do we need to get permission to quote a sentence or two from a PRI, Inc. publication?
A: No. Permission is not needed for quoting a small portion of a PRI,
Inc. article (e.g., a few sentences or a paragraph). Please follow
good citation practice and give proper attribution to the publication
and author.
Q: May we post or include a copy of a PRI, Inc. article on our website or client newsletter?
No: You must obtain our permission for any reproduction or
dissemination of this kind. However, we can provide you with a PDF
version of the article for a reasonable fee and a distribution
license. However, permission to distribute in this way may be
prohibited or limited for any or no reason.
Q: May I share my password with other individuals?
No. You may not share your password in individuals either inside, or
outside, of your organization. Passwords provide exclusive access to
the proprietary content located on the website of HAZMAT Packager &
Shipper™, by site license agreement only. Additional access can be purchased.
Q: May I summarize a The Journal of HazMat Transpotation™ article
and then post it on a website or disseminate it electronically to all
our employees?
No. In summarizing the article, you would be making a derivative
work of copyrighted material, which is not permitted. As stated above,
a PDF version of the article can be provided with a license to
distribute subject to restrictions.
Q. May a registered user of a PRI, Inc. electronic product e-mail
an article to another employee that does not have authorized access?
No. The content on PRI, Inc.'s website may not be e-mailed to
individual(s) who do not have authorized access to PRI, Inc.'s
content. Access to the website content, or distribution of content to
unauthorized users is not permitted. Additional access to the website
can be purchased via site license.
Q: I want to copy, reuse and distribute content of PRI, Inc. articles in different ways, how can I find out if I can do that?
We offer customer site license arrangements to accommodate
customers' individual information needs. Please contact us through our
website or the contact information page in our publications.
Q. Who may I contact to obtain permission to reproduce content from
any of PRI, Inc.'s products, purchase addtional site licenses, or order
electronic copies of content.
